 AB35 Support Makes various changes concerning provisions of public services for children (Youth aging out of foster care plan required.) Amended in Assembly (Ways and Means) to eliminate plan for transition from foster care to self-sufficiency and only provides drivers licenses and permits for children in foster care.  **AB36 Actively Support  Requires Director of Dept. of Human Resources to include in State Plan for Medicaid requirement that young adults who have "aged out" of foster care are eligible for Medicaid.  Amended in Assembly appropriation:  $377,377 to Health Care Financing and Policy; $119,601 to Welfare Div.; $40,449 to DCFS.  AB41 Actively Support Makes appropriation for operating expenses support of mental health court in Clark County.  Sponsor:  Horne. Exempt  Appropriation: $1 million each year of the biennium from General Fund.

Current Status:  First Reprint. Asm Amend (delete “operating expenses” and insert “support of” and re-referred to Ways and Means.  March 14 hearing in Ways and Means. No action. Died in Ways and Means at end of session.

AB42 Support Makes various changes concerning protection of children from abuse and neglect.  (Presumption that it is in best interest of child to be placed together with siblings.) Sponsor: Health and Human Services. Exempt. Final bill contains language from conference committee report: Assembly to concur in Senate amendments and further amend to include provision re. child care facilities that are run by businesses as an auxiliary service provided to their customers to require parents of child to provide proof of immunization to the facility.

AB43 Support Establishes certain rights for children who are placed in foster homes. Sponsor: Health and Human Services. Senate amendment deletes the word “rights” and used other language to describe rights of children.

Current Status:  First Reprint. Assembly amended and passed (unanimous). Senate amended and passed.  Assembly did not concur in amendment.  Senate did not recede.  1st Conference Committee. Died in Conference Committee end of session.

AB46 Actively Support.  Makes various changes concerning provision of child welfare services Extends committee on Children Youth and Families and recommends a study of Child Support Enforcement.  Also requires a plan for funding of child welfare services. Sponsor: Health and Human Services. Exempt.

Current Status:  Amended and Passed Asm.   In Senate Legislative Operations. Heard May 12. Died in committee end of session.

This committee was a very important committee.  Senate Legislative Operations chair Barbara Cegavske did not bring bill up for a vote in committee.  Barbara Buckley will chair the Legislative Commission during the interim and plans to create a subcommittee to study child support enforcement.

 AB47 Support Requires screening of certain delinquent children for mental health and substance abuse problems.   As amended: Requires certain children referred to the system of juvenile justice to be screened for mental health and substance abuse problems.  Sponsor: Judiciary.  Exempt.

AB51 No ActionOppose NWL position changed when SB109 was amended into bill. 

Provides procedure for parties to adoption to enter into enforceable agreement for postadoptive contact. (NASW only) This bill was amended on Senate floor to include language from SB109 stating joint custody to be in best interest of the child with a list of factors to be considered by the court.  We opposed this amendment. Conference committee report compromise:  keep best interest of child as primary concern, but require judges to consider a list of factors in determining best interest of child.

 AB60 Support Revises certain provisions regarding school personnel. As amended: Requires Dept. of Education transfer money from the DSA to provide signing bonuses to licensed employees who are newly hired by school districts. Sponsor: Education.  Exempt. (Amendment removes unfunded mandate. Increases appropriation from $5 million to $5.4 million.)

AB66 Support Requires reporting of certain gifts or other economic benefits provided by wholesalers or manufacturers regulated by State Board of Pharmacy. Sponsor: Conklin, Giunchigliani, Pierce, Leslie, Parks. (AARP lead) (Amendment changes reporting from Board of Pharmacy to the Office of the Attorney General) Senate Commerce amendment would prohibit drug retailers from selling lists of drug use.

Current Status:  First Reprint. Assembly amended and passed (26-16 almost along party lines: All D’s except Oceguera voted yes; All R’s except Weber voted no.  Senate Commerce recommended amend and do pass.  (AARP says amendments are acceptable.) Was not sent to floor.  Failed 5/27 deadline.

AB76 Monitor Authorizes boards of trustees of school districts to accommodate medical absences in policy for attendance of pupils at school. Sponsor: Education.

AB119 Monitor Requires certain nonprofit corporations that solicit contributions to register with Secretary of State. Failed 4/15 deadline. 

AB120 Support Requires physicians to report to their licensing boards certain information concerning performance of office-based surgery.  Amended to tighten up reporting.  Sponsor:  Gerhardt, Ohrenschall, Koivisto, Anderson.

AB465 Support Prohibits person from allowing child to be present within certain distance of in any conveyance or premises wherein certain crimes involving controlled substances other than marijuana are committed. (Amendment removed distance requirement and applied criminal penalties only to person who knowingly engages in or conspires with, aids or abets another person. AB493 Actively Support Requires Department of Human Resources to apply for Medicaid waiver pursuant to Health Insurance Flexibility and Accountability demonstration initiative. AB572 Introduced June 3 - Not discussed by NWL – $3 million tax rebate. Original Assembly bill rebate was based on gasoline tax paid.  Amended by Senate - Final reprint: Each owner of a motor vehicle registered in this state in 2004 will be issued a check equal to the basic government taxes and registration fee they paid (on each vehicle).  The minimum to be issued is $75 and maximum is $275.  And each person over 65 who has a valid identification card will be issued a check for $75.

SB22 Monitor Creates Interagency Advisory Board on Transition Services to study issues related to services for persons with disabilities who are transitioning from secondary school to adult living. SB77 Oppose Revises provisions pertaining to counseling required for person convicted of battery which constitutes domestic violence (If person lives more than 50 miles from counseling site, instead of 1 ½ hours each week, counseling can be done on a non-weekly basis for a total of 6 hrs per month. Senate amendment requires courts to submit reports about such counseling sessions). (Assembly amended to more than 70 miles and sessions every other week for a total of 6 hours per month. Court administrator will submit a report to LCB regarding the effectiveness of court ordered counseling for batterers and the effectiveness of biweekly counseling. Also requires administrator of Div of Mental Health and Developmental Services to submit a report to the legislature regarding progress made to certify D.V. programs.) Assembly amendment improves this bill by requiring reports as to effectiveness of D.V. counseling programs.Sponsor: Judiciary.
